🧬 1. Nature of Service & Pipeline Orchestration

InstaDNA operates as an interface and workflow orchestration tool for digital fashion styling, virtual wardrobe try-on, creative photography, and synthetic media visualization. Generative rendering tasks are routed to external, independent third-party cloud compute providers. InstaDNA reserves the right to modify, throttle, or substitute upstream providers at any time without notice. InstaDNA is strictly not an adult entertainment, pornographic, or sexually explicit service.

🔞 2. Strict 18+ Age Requirement (Adults Only)

InstaDNA is strictly restricted to individuals who are at least 18 years of age (or the age of majority in your jurisdiction). By accessing or using the platform, you represent and warrant that you are at least 18 years old. Minors are strictly prohibited from using the service.

🛡️ 3. Statutory Prohibitions & Acceptable Use (IT Rules 2021)

• Zero Tolerance for Minors (POCSO Act & IT Act): Any attempt to generate sexualized, abusive, or exploitative depictions of minors or age-ambiguous individuals is strictly prohibited, flagged, and subject to immediate account termination and legal reporting under the Protection of Children from Sexual Offences Act and the Information Technology Act, 2000.
• No Non-Consensual Imagery (NCII) or Deepfakes: Uploading reference photos of real people to generate nude, intimate, defamatory, or non-consensual depictions without explicit, verifiable written consent is strictly prohibited on InstaDNA and may violate applicable provisions of the Information Technology Act, 2000.
• No Deceptive Impersonation & Fraud: Do not use generated content for scams, deceptive impersonation, extortion, harassment, or unlawful acts (which may also constitute offenses under applicable law).
• No Explicit Sexual Acts: Generating depictions of explicit sexual intercourse, non-consensual violence, or commercial sex/escort services is strictly prohibited.

⚠️ 4. Notice of Consequences for Violations (MeitY Directives)

Under Ministry of Electronics and Information Technology (MeitY) directives, violations of Section 3 or applicable Indian laws will result in immediate removal of content, account suspension or termination without refund, preservation of audit records under Rule 3(1)(h) of the IT Rules 2021, and reporting to relevant authorities where required or permitted by applicable law.

💼 5. Zero Model Hosting & External Compute Architecture

InstaDNA does not host, store, train, or distribute machine learning foundation models, checkpoints, weights, or LoRA files on its infrastructure. InstaDNA stores your account data, reference assets, and generated outputs in managed cloud storage (Cloudflare R2) and cloud databases to maintain your studio creation history. To fulfill generation requests, input prompts and reference images may be securely transmitted to authorized external AI compute and inference providers. Parameter input fields allow referencing external model names at your own discretion; the provision of an input box does not constitute validation or endorsement by InstaDNA. You warrant that you hold all lawful rights for any external identifiers you reference. We do not train public AI foundation models on your private reference images.

🧪 6. Beta, Experimental & Preview Features

From time to time, InstaDNA may offer access to experimental or trial features (including preview video tools and experimental generation pipelines). Beta features are provided strictly on an evaluation basis with zero guarantees of reliability, output quality, or continuous availability. We reserve the right to throttle, alter, or discontinue any beta feature at any time without liability.

⚡ 7. Comprehensive AI Disclaimers (No 100% Guarantees)

• No 100% Likeness or Quality Guarantee: Generative AI is probabilistic. Outputs depend on statistical variations and prompts. We make no promise or warranty of 100% exact likeness, anatomical perfection, or photo-realism.
• No 100% Uptime Guarantee: Cloud GPU clusters and third-party APIs experience maintenance and latency. We do not promise 100% uninterrupted service or immediate queue turnaround.
• No 100% Moderation Guarantee: Automated filters cannot catch 100% of non-compliant prompts. You remain solely responsible for your inputs and creations.
• No Permanent Archive: Assets are stored in cloud storage (Cloudflare R2) and databases to provide your studio history. We do not operate a permanent backup service; users must maintain local copies of their assets.

🤝 8. User Uploads, Likeness Warranty & User Indemnification

You warrant that you hold all rights, licenses, and clearances for all uploaded photos and that any real person depicted has provided informed, written consent. You agree to defend, indemnify, and hold harmless InstaDNA and its operators from any claims, damages, or legal costs arising from your uploads, prompts, or external commercial use of generated media.

🏷️ 9. Output Rights & Synthetic Media Disclosure

InstaDNA does not claim ownership of content generated from your prompts, reference materials, or other inputs. Subject to applicable third-party service terms and applicable law, paid users may use generated outputs for personal or commercial purposes. InstaDNA does not guarantee that any generated output is copyrightable, exclusive, or free from third-party intellectual-property claims. When publishing synthetic or AI-generated media publicly, users should comply with applicable disclosure and labeling requirements.

💳 10. Billing, Digital Credits & Payment Processing

• Payment Processing: Payments may be processed through authorized third-party payment providers, including Razorpay (for domestic transactions in INR via UPI, NetBanking, Cards, and Wallets) and other authorized gateways as enabled.
• AI credits are consumable digital units. Once consumed for successful generation, credits are non-refundable. Failed generations due to technical server timeouts are automatically restored.

⚖️ 11. Grievance Redressal Mechanism (IT Rules 2021)

In accordance with Rule 3 of the IT Rules 2021, our designated Grievance Officer can be reached at support@theinstadna.com. Statutory response times: 24 hours for sexual/NCII content (Rule 3(2)(b)); 72 hours for priority violations; 15 days for general grievances.

🏛️ 12. Disclaimer of Warranties & Governing Law

The service is provided strictly on an “AS-IS” basis. Total aggregate liability is capped at the amount paid by you in the preceding 3 months. Governed by the laws of the Republic of India, with exclusive jurisdiction in the courts of India.
