Platform Guidelines & Terms of Service

InstaDNA (including its Dressé virtual try-on studio, persona creation tools, and associated creative modules) operates as an artificial intelligence-assisted creative software platform for digital fashion styling, virtual wardrobe try-on, artistic portraiture, and synthetic visual media visualization. By accessing or using our platform, you agree to use the service safely, ethically, and in strict accordance with these Platform Guidelines & Terms of Service.

🧬 1. Nature of Service & Pipeline Orchestration

InstaDNA operates as an interface and workflow orchestration tool. Generative rendering tasks are routed to external, independent third-party cloud compute providers (such as Google Cloud Vertex AI and remote compute networks). InstaDNA reserves the absolute right to alter, upgrade, throttle, or substitute upstream compute providers at any time without prior notice.

Not an Adult Entertainment Service: InstaDNA is a creative fashion, design, and portraiture tool. It is strictly not an adult entertainment, pornographic, or sexually explicit commercial service.

🔞 2. Strict 18+ Age Requirement (Adults Only)

InstaDNA is strictly restricted to individuals who are at least 18 years of age (or the age of majority in your jurisdiction). By creating an account or accessing any generation feature, you represent and warrant that you are at least 18 years of age. Any access or attempted use by individuals under 18 is strictly prohibited and constitutes a material breach of these Terms.

🛡️ 3. Statutory Prohibitions & Acceptable Use (Rule 3, IT Rules 2021)

  • Permitted Uses: Fashion styling, virtual wardrobe try-on, swimwear, creative portraiture, artistic storytelling, character visualization, and commercial brand design.
  • Zero Tolerance for Minors (POCSO Act & IT Act): Any attempt to generate sexualized, abusive, or exploitative depictions of minors or age-ambiguous individuals is strictly prohibited, flagged, and subject to immediate account termination and legal reporting to law enforcement authorities under the Protection of Children from Sexual Offences (POCSO) Act, 2012 and the Information Technology Act, 2000.
  • No Non-Consensual Imagery (NCII) or Deepfakes: Uploading reference photos of real individuals to generate nude, intimate, defamatory, or non-consensual depictions without the explicit, verifiable written consent of that individual is strictly prohibited on InstaDNA and may violate applicable provisions of the Information Technology Act, 2000.
  • No Deceptive Impersonation & Fraud: You shall not use generated content for scams, deceptive impersonation, extortion, harassment, or unlawful acts (which may also constitute offenses under applicable law).
  • No Explicit Sexual Acts or Prostitution: Generating depictions of explicit sexual intercourse, non-consensual violence, or commercial sex/escort services is strictly prohibited.
  • Respect National Security & Intellectual Property: Users must not upload materials or generate assets that infringe third-party patents, trademarks, copyrights, or publicity rights, or threaten the unity, integrity, defense, security, or sovereignty of India.

⚠️ 4. Notice of Consequences for Violations (MeitY Directives)

In accordance with directives issued by the Ministry of Electronics and Information Technology (MeitY), you are hereby expressly informed that in the event of any violation of Section 3 or applicable Indian laws, InstaDNA reserves the operational right to:

  • Immediately remove, disable access to, or delete non-compliant generations or reference assets;
  • Suspend or permanently terminate your user account and revoke remaining digital credits without refund;
  • Preserve audit and incident records (including IP addresses, timestamps, and generation payloads) as required by Rule 3(1)(h) of the IT Rules 2021;
  • Report the incident to relevant law enforcement authorities where required or permitted by applicable law.

💼 5. Zero Model Hosting & External Compute Architecture

  • No Model Hosting: InstaDNA does not host, store, train, or distribute machine learning foundation models, checkpoints, weights, or LoRA files on its own infrastructure.
  • InstaDNA Storage vs. External Inference: InstaDNA stores your account records, persona profiles, reference assets, and generated outputs in managed cloud storage (Cloudflare R2) and cloud databases to maintain your studio creation history. To fulfill generation requests, input prompts and reference images may be securely transmitted to authorized external AI compute and inference providers.
  • Parameter Identifiers: The platform may provide input fields or preset menus that reference external model or LoRA identifiers. The provision of an input field or technical transmission of an identifier string does not constitute validation, licensing, endorsement, or hosting of that model by InstaDNA.
  • User Warranty on Identifiers: You represent and warrant that you hold all lawful rights, licenses, and permissions to invoke any third-party model or style identifiers you instruct the platform to process.
  • Zero Public Model Training: InstaDNA does not use your private reference photographs or private persona configurations to train public AI foundation models.

🧪 6. Beta, Experimental & Preview Features

From time to time, InstaDNA may make available certain beta, preview, experimental, or trial features (including trial video generation modules, experimental upscalers, or third-party workflow prototypes).

No Promises or Continuity: Beta features are provided strictly on an evaluation basis. InstaDNA makes no promise or guarantee that beta features will operate without error, maintain continuous uptime, or ever be released as permanent commercial features. InstaDNA reserves the right to throttle, modify, alter access rules for, or permanently discontinue any beta or experimental feature at any time without liability or compensation.

⚡ 7. Comprehensive AI Disclaimers (No 100% Guarantees)

  • No Guarantee of Exact Likeness or Photorealism: Generative AI is a probabilistic machine learning technology. Outputs depend on statistical variations, prompt phrasing, and model weights. InstaDNA makes no promise, warranty, or guarantee of 100% exact likeness preservation, 100% anatomical correctness, or 100% photographic perfection. Outputs may exhibit visual anomalies, distortions, or artifacts.
  • No Guarantee of 100% Uptime or Processing Speed: Generation tasks depend on external cloud GPU availability and third-party APIs. InstaDNA does not promise 100% uninterrupted service, zero latency, or immediate queue processing. Temporary downtime, provider outages, or queue congestion do not constitute a breach of service.
  • No Guarantee of 100% Moderation Filtering: While InstaDNA maintains automated and manual safeguards to prevent misuse, no automated filter is 100% effective. InstaDNA makes no warranty that its filters will catch every non-compliant prompt or asset. You remain strictly and solely responsible for your inputs and outputs.
  • No Guarantee of Permanent Storage: Reference photos and generated media are stored in managed cloud object storage (Cloudflare R2) and cloud databases to provide your creation history and studio gallery. InstaDNA does not operate as a permanent cloud backup service and makes no promise of indefinite or permanent data archiving. You are strongly advised to download and maintain your own local copies of generated assets.

🤝 8. User Uploads, Likeness Warranty & User Indemnification

User Warranty on Inputs: You represent and warrant that you own or hold all necessary intellectual property rights, licenses, and written clearances for all photographs, garments, logos, and reference media uploaded by you. If your upload includes the face, body, or likeness of any real person, you represent and warrant that you have obtained their prior, informed, written consent to upload their photograph and generate synthetic derivative media.

User Indemnification: You agree to defend, indemnify, and hold harmless InstaDNA, its founders, operators, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and legal expenses arising out of or related to: (a) any reference asset, photo, or prompt submitted by you; (b) any claim that your generation violates third-party copyright, trademark, privacy, or likeness/publicity rights; or (c) any publication, sharing, or commercial use of generated media by you outside the platform.

🏷️ 9. Output Rights & Synthetic Media Disclosure

  • User-Generated Outputs: InstaDNA does not claim ownership of content generated from your prompts, reference materials, or other inputs. Subject to applicable third-party service terms and applicable law, paid users may use generated outputs for personal or commercial purposes.
  • No Guarantees of Copyright or Exclusivity: InstaDNA does not guarantee that any generated output is copyrightable, exclusive, or free from third-party intellectual-property claims. Users are responsible for ensuring that their intended use of generated content complies with applicable law and does not infringe the rights of others.
  • Synthetic Media Disclosure: When publishing synthetic or AI-generated media publicly, users should comply with applicable disclosure and labeling requirements.
  • Platform Assets: Curated styling workflows, parameter configurations, prompt-building logic, and application UI remain the intellectual property of InstaDNA.

💳 10. Billing, Digital Credits & Payment Processing

  • Payment Processing: Payments and subscriptions may be processed through authorized third-party payment providers, including Razorpay (for transactions in INR via UPI, NetBanking, Debit/Credit Cards, and Wallets) and other authorized payment gateways as enabled. We do not store sensitive payment card numbers, CVVs, or NetBanking passwords on our servers.
  • Digital Utility Credits: AI credits are consumable digital utility units used to execute generation compute. Once credits are consumed for a completed generation, they are non-refundable.
  • Automatic Technical Restorations: If a generation fails to produce an output due to an internal server error or upstream provider timeout, the credits deducted for that specific failed attempt are automatically restored to your balance.
  • Subscription Cancellation: You can cancel your subscription at any time through your account billing settings. Your plan benefits and remaining subscription credits will remain active until the end of your current billing cycle. Verified duplicate charges will be refunded promptly upon review.

⚖️ 11. Grievance Redressal Mechanism & Statutory Timelines (IT Rules 2021)

In accordance with Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, if you believe any content on the platform violates your rights, bodily privacy, or these terms, you may contact our designated Grievance Officer:

Statutory Timelines:
  • Sexual Content / Nudity / Impersonation (Rule 3(2)(b)): Access disabled / removed within 24 hours of valid complaint.
  • Priority Violations & Misinformation (2022 Amendments): Resolved within 72 hours.
  • General Grievances (Rule 3(2)(a)): Acknowledged within 24 hours; resolved within 15 days.

🏛️ 12. Disclaimer of Warranties, Limitation of Liability & Governing Law

"AS-IS" Provision: The service is provided strictly on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

Cap on Liability: To the maximum extent permitted by Indian law, InstaDNA and its operators shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of the service. In no event shall our total aggregate liability for any direct claim exceed the total amount paid by you to InstaDNA in the preceding three (3) months.

Governing Law & Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
