InstaDNA (including its Dressé virtual try-on studio, persona creation tools, and associated creative modules) operates as an artificial intelligence-assisted creative software platform for digital fashion styling, virtual wardrobe try-on, artistic portraiture, and synthetic visual media visualization. By accessing or using our platform, you agree to use the service safely, ethically, and in strict accordance with these Platform Guidelines & Terms of Service.

🧬 1. Nature of Service & Pipeline Orchestration

InstaDNA operates as an interface and workflow orchestration tool for digital fashion styling, virtual wardrobe try-on, creative photography, and synthetic visual media visualization. Generative rendering tasks are routed to external, independent third-party cloud compute providers (such as Google Cloud Vertex AI and remote compute networks). InstaDNA reserves the absolute right to alter, upgrade, throttle, or substitute upstream compute providers at any time without prior notice. Commercial subscription plans and digital credits apply exclusively to primary image synthesis, digital styling, and virtual try-on features.

Not an Adult Entertainment Service: InstaDNA is a creative fashion, design, and portraiture tool. It is strictly not an adult entertainment, pornographic, or sexually explicit commercial service.

🔞 2. Strict 18+ Age Requirement & Statutory Child Protection

Platform Eligibility: InstaDNA is strictly restricted to individuals who are at least 18 years of age (or the age of legal majority in your jurisdiction). By creating an account or accessing any generation feature, you represent and warrant that you are at least 18 years of age. Any access or attempted use by individuals under 18 is strictly prohibited and constitutes a material breach of these Terms.

Statutory Child Protection (POCSO Act & IT Act): An account holder's age declaration does not diminish, alter, or eliminate the absolute statutory prohibitions concerning Child Sexual Abuse Material (CSAM) or non-consensual exploitation of minors under the Protection of Children from Sexual Offences (POCSO) Act, 2012 and Section 67B of the Information Technology Act, 2000. InstaDNA maintains an uncompromising zero-tolerance policy, with immediate account termination, evidence preservation, and mandatory law enforcement reporting for any attempt to generate abusive or sexualized depictions involving minors.

🛡️ 3. Statutory Prohibitions & Acceptable Use (Rule 3, IT Rules 2021)

  • Permitted Uses: Fashion styling, virtual wardrobe try-on, swimwear, creative portraiture, artistic storytelling, character visualization, and commercial brand design.
  • Zero Tolerance for Minors (POCSO Act & IT Act): Any attempt to generate sexualized, abusive, or exploitative depictions of minors or age-ambiguous individuals is strictly prohibited, flagged, and subject to immediate account termination and legal reporting to law enforcement authorities under the Protection of Children from Sexual Offences (POCSO) Act, 2012 and the Information Technology Act, 2000.
  • No Non-Consensual Imagery (NCII) or Deepfakes: Uploading reference photos of real individuals to generate nude, intimate, defamatory, or non-consensual depictions without the explicit, verifiable written consent of that individual is strictly prohibited on InstaDNA and may violate applicable provisions of the Information Technology Act, 2000.
  • Synthetically Generated Information (SGI) & Misinformation: Users must not generate, upload, or transmit synthetically generated information (SGI) or altered media designed to deceive or mislead regarding its real origin, authenticity, or depiction of any person without verifiable written consent, or that promotes misinformation, communal disharmony, or defamation.
  • No Deceptive Impersonation & Fraud: You shall not use generated content for scams, deceptive impersonation, extortion, harassment, or unlawful acts (which may also constitute offenses under applicable law).
  • No Explicit Sexual Acts or Prostitution: Generating depictions of explicit sexual intercourse, non-consensual violence, or commercial sex/escort services is strictly prohibited.
  • Respect National Security & Intellectual Property: Users must not upload materials or generate assets that infringe third-party patents, trademarks, copyrights, or publicity rights, or threaten the unity, integrity, defense, security, or sovereignty of India.

⚠️ 4. Notice of Consequences for Violations (MeitY Directives)

In accordance with directives issued by the Ministry of Electronics and Information Technology (MeitY), you are hereby expressly informed that in the event of any violation of Section 3 or applicable Indian laws, InstaDNA reserves the operational right to:

  • Immediately remove, disable access to, or delete non-compliant generations or reference assets;
  • Suspend or permanently terminate your user account and revoke remaining digital credits without refund;
  • Preserve audit and incident records (including IP addresses, timestamps, and generation payloads) as required by Rule 3(1)(h) of the IT Rules 2021;
  • Report the incident to relevant law enforcement authorities where required or permitted by applicable law.

💼 5. Zero Model Hosting & External Compute Architecture

  • No Model Hosting: InstaDNA does not host, store, train, or distribute machine learning foundation models, checkpoints, weights, or LoRA files on its own infrastructure.
  • InstaDNA Storage vs. External Inference: InstaDNA stores your account records, persona profiles, reference assets, and generated outputs in managed cloud storage (Cloudflare R2) and cloud databases to maintain your studio creation history. To fulfill generation requests, input prompts and reference images may be securely transmitted to authorized external AI compute and inference providers.
  • Parameter Identifiers: The platform may provide input fields or preset menus that reference external model or LoRA identifiers. The provision of an input field or technical transmission of an identifier string does not constitute validation, licensing, endorsement, or hosting of that model by InstaDNA.
  • User Warranty on Identifiers: You represent and warrant that you hold all lawful rights, licenses, and permissions to invoke any third-party model or style identifiers you instruct the platform to process.
  • Zero Public Model Training: InstaDNA does not use your uploaded reference photographs or private persona configurations to train its own public models. External third-party compute providers process data in accordance with their respective applicable terms, enterprise agreements, and privacy policies.

🧪 6. Beta, Experimental & Personal-Use Features

From time to time, InstaDNA may maintain or test experimental developer tools, preview upscalers, or third-party workflow prototypes. Any experimental features or external compute pipelines are strictly non-commercial, private beta or developer evaluation utilities for personal/internal use only. They are not part of any commercial subscription offering or service level agreement (SLA).

No Promises, Public Access, or Continuity: Experimental and personal-use utilities are provided strictly on an evaluation basis. InstaDNA makes no promise or guarantee that experimental features will be publicly available, operate without error, or remain accessible. InstaDNA reserves the right to restrict, hide, throttle, or permanently disable any experimental feature or provider access at any time without liability or compensation.

⚡ 7. Comprehensive AI Disclaimers (No 100% Guarantees)

  • No Guarantee of Exact Likeness or Photorealism: Generative AI is a probabilistic machine learning technology. Outputs depend on statistical variations, prompt phrasing, and model weights. InstaDNA makes no promise, warranty, or guarantee of 100% exact likeness preservation, 100% anatomical correctness, or 100% photographic perfection. Outputs may exhibit visual anomalies, distortions, or artifacts.
  • No Guarantee of 100% Uptime or Processing Speed: Generation tasks depend on external cloud GPU availability and third-party APIs. InstaDNA does not promise 100% uninterrupted service, zero latency, or immediate queue processing. Temporary downtime, provider outages, or queue congestion do not constitute a breach of service.
  • No Guarantee of 100% Moderation Filtering: While InstaDNA maintains automated and manual safeguards to prevent misuse, no automated filter is 100% effective. InstaDNA makes no warranty that its filters will catch every non-compliant prompt or asset. You remain strictly and solely responsible for your inputs and outputs.
  • No Guarantee of Permanent Storage & Asset URLs: Reference photos and generated media are stored in managed cloud object storage (Cloudflare R2) and cloud databases to provide your creation history and studio gallery. Media is access-controlled within the InstaDNA application, with asset URLs that may function as unlisted bearer links where applicable (accessible without an active login session if the exact unguessable UUID string is known). InstaDNA does not operate as a permanent cloud backup service and makes no promise of indefinite or permanent data archiving. You are strongly advised to download and maintain your own local copies of generated assets.

🤝 8. User Uploads, Likeness Warranty & Limited Processing License

User Warranty on Inputs: You represent and warrant that you own or hold all necessary intellectual property rights, licenses, and written clearances for all photographs, garments, logos, and reference media uploaded by you. If your upload includes the face, body, or likeness of any real person, you represent and warrant that you have obtained their prior, informed, written consent to upload their photograph and generate synthetic derivative media.

User Ownership & Limited Service License: You retain whatever ownership rights you have in your uploaded reference images. InstaDNA does not claim ownership of your uploaded reference images. To operate the platform and deliver requested generations, you grant InstaDNA a strictly limited, non-exclusive, royalty-free license solely to ingest, store, process, resize, and transmit your uploaded reference images, prompts, and Persona DNA configurations to authorized upstream compute providers (such as Google Cloud Vertex AI and remote compute clusters) to generate requested synthetic media, create preview thumbnails, and maintain your studio creation history. InstaDNA does not sell or commercially exploit your uploaded photographs.

Persona DNA Architecture: Persona DNA refers to technical appearance parameters, facial consistency configurations, prompt weightings, and visual reference anchors configured within your studio library to maintain identity consistency across generations. Persona DNA configurations do not constitute biometric facial identification templates, government biometric identification, or facial surveillance data.

User Indemnification: You agree to defend, indemnify, and hold harmless InstaDNA, its founders, operators, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and legal expenses arising out of or related to: (a) any reference asset, photo, or prompt submitted by you; (b) any claim that your generation violates third-party copyright, trademark, privacy, or likeness/publicity rights; or (c) any publication, sharing, or commercial use of generated media by you outside the platform. This indemnity is strictly limited to matters attributable to your inputs, instructions, or unauthorized use, and does not require you to indemnify InstaDNA for InstaDNA's own gross negligence, willful misconduct, or intentional statutory non-compliance.

🏷️ 9. Output Rights & Synthetic Media Disclosure

  • User-Generated Outputs: InstaDNA does not claim ownership of your generated outputs. Subject to applicable law, third-party provider terms, and rights relating to your inputs, you may use outputs generated through your account for personal or commercial purposes where your plan permits such use.
  • No Guarantees of Copyright or Exclusivity: InstaDNA does not guarantee that any generated output is copyrightable, exclusive, or free from third-party intellectual-property claims. Users are responsible for ensuring that their intended use of generated content complies with applicable law and does not infringe the rights of others.
  • Synthetic Media Disclosure & Technical Provenance: When publishing, sharing, or distributing synthetic or AI-generated media publicly, users are solely responsible for complying with applicable statutory disclosure and labeling requirements under Indian law and social platform guidelines. (Technical Provenance Notice: InstaDNA embeds Synthetically Generated Information (SGI) metadata in image headers (EXIF) and visual branding badges on free-tier outputs documenting synthetic AI generation origin; users publishing or distributing generated media must independently comply with applicable local disclosure and labeling laws).
  • Platform Assets: Curated styling workflows, parameter configurations, prompt-building logic, and application UI remain the intellectual property of InstaDNA.

💳 10. Billing, Digital Credits & Prepaid Term Processing (Razorpay Only)

  • Exclusive Payment Processor: Payments and prepaid plans are processed exclusively through our authorized payment processor, Razorpay Software Private Limited ("Razorpay") for transactions in Indian Rupees (INR) via UPI, NetBanking, Debit/Credit Cards, and Wallets. We do not store sensitive payment card numbers, CVVs, or NetBanking passwords on our servers. Razorpay processes the financial transaction; InstaDNA independently determines plan pricing, credit allocations, generation compute costs, and refund eligibility.
  • Digital Utility Credits & Reservation Architecture: AI credits are consumable digital utility units used to execute generation compute.
    • One-Time Purchased Credit Top-Up Packs: Purchased credit top-up packs do not expire and remain active in your account ledger indefinitely until consumed.
    • Prepaid Plan Credits: Credits allocated under prepaid plan terms (30-day or 12-month terms) are provisioned upfront for the duration of the purchased prepaid validity period. Unspent prepaid plan credits do not roll over or accumulate past the prepaid validity expiration.
    • Atomic Reservation & Settlement Architecture: Required credits are conditionally reserved when a generation is initiated. Credits are permanently committed and settled strictly upon successful output delivery. If a generation request fails, encounters an upstream GPU timeout, or is rejected by safety filters, the reserved credits are immediately and automatically released back to your balance. Once credits are settled for completed generations, they are non-refundable.
  • Prepaid Access & Non-Renewing Terms: Plans are purchased as fixed prepaid terms (30 days or 12 months) with upfront credit grants. They do not auto-renew or incur recurring recurring card charges. You retain full access to plan benefits and remaining credits throughout your prepaid validity period.   • Refund Processing: In accordance with our Refund & Cancellation Policy, verified duplicate charges or approved refunds will be credited back to your original payment method via Razorpay within 5 to 7 business days in accordance with standard banking processing timelines.

⚖️ 11. Grievance Redressal Mechanism & Statutory Timelines (IT Rules 2021)

In accordance with Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, if you believe any content on the platform violates your rights, bodily privacy, or these terms, you may contact our designated Grievance Officer:

Category-Specific Statutory Timelines: Where applicable, InstaDNA processes grievances in accordance with the timelines and procedures prescribed by applicable Indian law:
  • Government or Court Orders (Rule 3(1)(d)): Actioned as soon as possible and in any case within 3 hours upon receipt of actual knowledge via court order or authorized government notification.
  • Bodily Privacy & Non-Consensual Imagery (Rule 3(2)(b)): Complaints concerning depictions of private areas, nudity, sexual acts, or non-consensual impersonation/morphed imagery are actioned expeditiously and access disabled within 2 hours of receipt of a prima facie valid complaint.
  • Specified Prohibited Content Removal (First Proviso to Rule 3(2)(a)(i)): Removal requests for information prohibited under Rule 3(1)(b) (other than Rule 3(2)(b) and Rule 3(1)(d)) are actioned within 36 hours.
  • General Grievances (Rule 3(2)(a)(i)): Formally acknowledged within 24 hours and resolved/disposed of within 7 days of receipt (as amended under current IT Rules).
Note: These timelines represent statutory compliance benchmarks under Indian law that our compliance desk works in good faith to meet. They do not constitute independent private contract warranties or strict-liability service level guarantees.

🏛️ 12. Disclaimer of Warranties, Limitation of Liability & Governing Law

"AS-IS" Provision: The service is provided strictly on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise, to the maximum extent permitted by applicable law.

Cap on Liability: To the maximum extent permitted by applicable law, InstaDNA, its operators, founders, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of the service. In no event shall our total aggregate liability for any direct claim exceed the total amount paid by you to InstaDNA in the preceding three (3) months. Nothing in these Terms shall limit or exclude any statutory consumer guarantees or rights that cannot lawfully be limited, disclaimed, or excluded under the Consumer Protection Act, 2019 or other applicable Indian consumer laws.

Governing Law & Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.

Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, such provision shall be severed from the remainder of these Terms, which shall remain in full force and effect.
